    Welcome to the Albertina Antique Jewelry Website

    The Albertina Antique Jewelry website (the “Gallery,” the “Website,” “we,” “us,” or “our”) is operated and managed by the Gallery. It presents collections of antique and vintage jewelry and selected antiques, as well as professional content, articles, advisory services, and further information about the Gallery’s activities.

    The Gallery specializes in rare antique jewelry. Each item is carefully selected for its historical, artistic, and aesthetic value. In many cases, an item is unique and cannot be replaced.

    This document governs use of the Website and sets out the Gallery’s Privacy Policy, including the collection, use, retention, and protection of personal information and users’ rights, under the Israeli Protection of Privacy Law, 5741-1981, as amended from time to time, including Amendment No. 13, which entered into force on August 14, 2025 (the “Law”).

    Use of the Website, including browsing, viewing products, contacting the Gallery, subscribing to communications, or making a purchase, is subject to these Terms. If you do not agree to all or part of them, please discontinue your use of the Website.

    1. Definitions

    “Website” means the Albertina Antique Jewelry website, including its pages, services, and content.

    “Gallery” means Albertina Antique Jewelry and its owner, acting as the controller of a database to the extent that information is retained in a database under its control.

    “User” means any person who browses the Website, contacts the Gallery, makes a purchase, or otherwise uses the Website.

    “Item” means any jewelry item, antique, watch, accessory, or other product displayed on the Website.

    “Content” means any text, image, video, design, logo, trademark, product description, blog post, article, or other material appearing on the Website.

    “Personal Information” means data relating to an identified person or a person identifiable, directly or indirectly, by reasonable means, including an online identifier.

    “Information of Special Sensitivity” means personal information of a type defined as such under the Law.

    “Processing” or “Use” means any operation performed on personal information, as defined by the Law.

    2. Eligibility to Use the Website

    Use of the Website and purchases through it are intended for persons aged 18 or older. A minor may use the Website only with the approval and supervision of a parent or legal guardian. Each User represents that they have the legal capacity to undertake binding legal actions under applicable law.

    3. Scope of These Terms

    These Terms apply to all pages, services, and content on the Website, including product viewing, inquiries, purchases, subscriptions, articles, and online forms. If any provision conflicts with a mandatory provision of law, the mandatory provision shall prevail.

    4. Permitted Use

    The Website must be used lawfully, fairly, and in good faith. Users may not violate any law or third-party right; disrupt the Website; introduce malicious code; perform data mining, automated scraping, or systematic collection without prior written authorization; commercially exploit Website Content without permission; or unlawfully process another person’s personal information.

    The Gallery may restrict or block access where use is inconsistent with these Terms or applicable law.

    5. Information Presented on the Website

    The Gallery makes efforts to present accurate, professional, and current information. Website information is general and does not constitute a valuation, investment advice, legal advice, or a recommendation to purchase a particular Item. Product descriptions are based on professional examination, experience, and accepted sources, but typographical errors, omissions, or inaccuracies may occur. The Gallery may update or correct information at any time.

    6. Images, Measurements, and Colors

    The Gallery endeavors to provide high-quality images with colors that closely reflect the Item. Colors may vary due to screens, display settings, and lighting, and digital enlargement may emphasize signs of age or use. Measurements stated in the product description shall prevail if the apparent size in an image differs from the Item’s actual dimensions. Additional images, videos, and measurements may be requested before purchase.

    7. The Unique Nature of Antique Items

    Most Items on the Website are antiques, vintage pieces, or rare collectibles. They may show signs of age, use, natural wear, historical repairs, or characteristics resulting from their period and preservation. Such characteristics are not necessarily defects; they may form part of the Item’s authenticity, age, and history.

    8. Product Availability

    Most Items are one of a kind. Availability is not guaranteed until a transaction is completed and confirmed. If an Item becomes unavailable before completion, the Gallery will notify the customer as soon as practicable, and any amount paid for it will be refunded in accordance with applicable law.

    9. Prices

    Prices are displayed in the currency selected on the Website and may be updated without prior notice. The binding price is the price confirmed in the transaction. An obvious pricing error, typographical error, or technical malfunction does not bind the Gallery, and the Gallery may cancel a transaction resulting from such an error, subject to applicable law.

    10. Information Before Purchase

    The Gallery encourages customers to contact it before purchasing a high-value Item. Where possible, it will provide additional images, videos, measurements, historical or gemological information, and details regarding shipping, insurance, and payment, to support an informed purchase decision.

    11. Secure Payments

    Payments are processed through commonly used payment and service providers. Payment-method information is processed by those providers under their security procedures. As a rule, the Gallery does not retain customers’ complete credit-card details.

    12. Intellectual Property and Use of Content

    All intellectual property rights in the Website, including its texts, product descriptions, articles, photographs, videos, design, logo, trademarks, and databases, belong to the Gallery or to third parties that have authorized their use.

    No Content may be copied, reproduced, published, distributed, translated, adapted, sold, publicly displayed, or commercially used without prior written consent. Links to Website pages may be shared, provided the Content is not altered and no endorsement or sponsorship by the Gallery is implied.

    13. Trademarks

    The names Albertina, Albertina Antique, and Albertina Antique Jewelry, together with the Gallery’s logo, symbols, and branding, are assets of the Gallery or their respective rights holders. They may not be used without prior written authorization.

    14. External Links and Services

    The Website may include links to, or services provided by, third parties, including social networks, payment services, shipping companies, and content providers. The Gallery does not control their content, privacy practices, security, or availability. Use of those services is subject to their own terms and policies.

    15. User Responsibility

    Users undertake to provide accurate, complete, and current information when contacting the Gallery, subscribing, or making a purchase, and are responsible for actions performed using the details they provide. If personal accounts become available in the future, Users will be responsible for keeping login credentials confidential and promptly reporting unauthorized use.

    16. Website Operation and Limitation of Liability

    The Website and its services are provided “AS IS” and “AS AVAILABLE.” The Gallery takes reasonable measures to maintain the Website and its security but does not guarantee uninterrupted or error-free operation. It may carry out maintenance, updates, and modifications or temporarily suspend a service.

    Subject to applicable law, the Gallery and its representatives shall not be liable for indirect, special, or consequential loss arising from use of the Website or reliance on its Content. Nothing in these Terms excludes liability or a right that cannot lawfully be excluded.

    17. Force Majeure

    Subject to applicable law, the Gallery shall not be liable for delay or inability to provide a service due to circumstances beyond its reasonable control, including war, hostilities, a state of emergency, an epidemic, a strike, a communications failure, a cyberattack, a natural disaster, or an order of a competent authority.

    18. Commitment to Privacy

    The Gallery respects Users’ privacy and seeks to act transparently regarding the collection of personal information, its purposes, retention, and transfer. Personal information will be processed for the purposes communicated to the User, to provide a service or perform a transaction, to comply with a legal duty or authority, or on the basis of consent where required. Information will not be used beyond the purpose for which it was provided unless permitted by law or supported by appropriate consent.

    19. Information We May Collect

    Information may include a name, email address, telephone number, shipping address, country and region, the content of inquiries, order and purchase information, language and currency preferences, and information provided when subscribing to communications.

    Technical information may also be collected automatically, including IP address, browser and device type, operating system, usage times, pages viewed, and statistical data.

    The Gallery seeks to collect information only to the extent necessary for the purposes set out in this Policy. In the ordinary course of Website activity, it does not ask Users to provide Information of Special Sensitivity that is unnecessary. Users should not submit such information through open forms unless expressly requested and given an appropriate explanation.

    20. Providing Information and Notice to Users

    When personal information is collected, Users will be provided, to the extent required by law, with information concerning the purpose of collection; whether there is a legal obligation to provide the information or whether it is voluntary; the consequences of not providing it; the identity and contact details of the database controller; the recipients of the information and purposes of disclosure; and the rights of access and correction.

    As a rule, there is no legal obligation to provide information. However, without certain details, the Gallery may be unable to respond to an inquiry, provide a service, or complete a transaction. Where consent is required, it will be requested appropriately and separately.

    21. Purposes of Using Information

    Information may be used to respond to inquiries; process and deliver orders; provide customer service; send order confirmations and shipping updates; improve the Website and services; maintain security and prevent fraud and misuse; meet legal, accounting, and tax obligations; and manage or defend legal rights. Marketing communications will be sent only in accordance with applicable law and any required consents.

    22. Marketing Communications

    Subscription to news, articles, and offers is voluntary and governed by the Israeli Communications Law (Telecommunications and Broadcasting), 5742-1982, and other applicable law. A subscription may be cancelled at any time through the unsubscribe link in a message or by contacting the Gallery. Unsubscribe requests will be handled in accordance with applicable law.

    23. Cookies and Similar Technologies

    The Website uses cookies and similar technologies for operation, security, preference storage, performance measurement, statistical analysis, and improving the User experience. Some are placed by external providers, including Shopify and analytics or service providers.

    Cookies may be managed through browser settings and any consent-management tool displayed on the Website. Blocking essential cookies may impair Website functionality.

    24. Disclosure to Third Parties

    The Gallery does not sell personal information. To the extent necessary, information may be disclosed to service providers such as Shopify, payment processors, shipping companies, hosting providers, information-security providers, mailing-service providers, and technical-support providers; to professional advisers; or to a competent authority where disclosure is required or authorized by law. Service providers are required to use the information for the relevant service and protect it under their agreements and applicable law.

    25. Transfers Outside Israel

    Personal information may be processed or stored outside Israel by the Website’s service providers. Such transfers will be made in accordance with the legal requirements governing the transfer of information outside Israel and through an appropriate legal mechanism, where required.

    26. Information Retention

    Information will be retained for a period reasonably necessary for the purposes for which it was collected, compliance with legal and accounting duties, dispute resolution, and protection of rights.

    Transaction and accounting records will be retained for the period required by law; service inquiries for a reasonable period for handling and follow-up; mailing information until the User unsubscribes, except for minimal data needed to record the opt-out; and technical information according to operational needs and providers’ policies. When the relevant period ends, information will be deleted or anonymized where practicable and subject to applicable law.

    27. Rights Relating to Personal Information

    Under the conditions and exceptions set out in the Law, every person is entitled to access information about themselves held in a database, either personally or through a duly authorized representative. A person who reviews information and finds it incomplete, unclear, or out of date may request that it be corrected or deleted in accordance with the Law.

    Users may also request to stop receiving marketing communications and direct mail in accordance with applicable law. Other requests, including deletion requests, will be considered in light of the rights and obligations applicable in the circumstances. Before providing access or making a change, the Gallery may request reasonable information to verify the requester’s identity. A person who believes their privacy has been infringed may contact the Israeli Privacy Protection Authority or a competent court.

    28. Information Security

    The Gallery implements reasonable technological, organizational, and administrative measures in accordance with the Law and the Israeli Protection of Privacy Regulations (Data Security), 5777-2017. Measures may include encrypted communications, access controls, password practices, and system updates.

    Security is an ongoing process, but no system is completely immune from malfunction or intrusion. In the event of a security incident, the Gallery will act in accordance with its applicable duties, including reporting obligations where required by law.

    29. Data Protection Officer

    Amendment No. 13 requires certain categories of organizations to appoint a Data Protection Officer, depending on the characteristics of their activities and information processing. The Gallery will periodically assess whether this obligation applies to it. If an appointment becomes mandatory, the officer’s contact details will be published. Privacy questions and requests may in all cases be directed to the Gallery using the details in Section 34.

    30. Changes to the Website and Services

    The Gallery may update, modify, add, or remove products, services, content, prices, promotions, or Website components. No change will apply retroactively to a completed transaction unless otherwise required by law.

    31. Updates and Supplementary Policies

    The Gallery may update this document due to changes in its activities, technology, services, or applicable law. The date of the latest update will appear at the beginning. Where the law requires further notice or consent, the Gallery will act accordingly.

    The Shipping Policy, Cancellation and Returns Policy, and any other policy published on the Website form an integral part of these Terms. In the event of a conflict regarding a specific subject, the specific provision shall prevail, subject to applicable law.

    32. Governing Law and Jurisdiction

    Use of the Website, dealings with the Gallery, and these Terms are governed by the laws of the State of Israel. Jurisdiction will be determined in accordance with applicable law. To the extent the parties may validly agree on venue, local jurisdiction shall lie with the competent courts in the Tel Aviv-Jaffa District.

    33. General Provisions

    Failure to exercise a right in a particular instance does not constitute a waiver. If any provision is held invalid or unenforceable, the remaining provisions will remain effective. Together with the supplementary policies, this document governs use of the Website, subject to mandatory provisions of law.

    These Terms may be available in additional languages. If the Hebrew version and a translation differ or conflict, the Hebrew version shall prevail unless applicable law requires otherwise.
